Abstract

The tradition of tajdid nikah with elements of tajammul refers to the renewal of a marriage contract that has developed within certain communities. This practice raises legal issues when society understands it as a religious obligation. This study aims to analyze the practice of tajdid nikah with tajammul at the Office of Religious Affairs (KUA) of Sumowono District, Semarang Regency. This research employs field research using an empirical-juridical approach. The findings show that the factors encouraging tajdid nikah can be divided into two categories. First, corrective factors, namely doubts or errors in the previous marriage contract, which lead couples to renew the contract as a form of ihtiyat or precaution. Second, socio-cultural factors, such as the desire to beautify the marriage contract procession, renew marital commitment, seek blessings, or follow local traditions. From the perspective of Islamic law, tajdid nikah with tajammul is acceptable as long as it fulfills the pillars and requirements of marriage, is not believed to be a religious obligation, does not invalidate the first marriage contract, and does not cause harm to the couple
